Competition Regulations of the Organizers
„Mother Earth & INES Jewellery”
(hereinafter: "Regulations")
§ 1. Organizer
The organizers of this competition (hereinafter: "Competition") are:
1. Competition Organizer No. 1 is "Alex" Aleks Nowicki Company, entered into the Central Register and Information on Economic Activity of the Republic of Poland maintained by the minister responsible for economy, with: business address: ul. Jacka i Agatki 4/13, 02-495 Warsaw, and correspondence address: "Mother Earth" ul. Jacka i Agatki 4/13, 02-495 Warsaw, NIP 5222840217, REGON 142713260, which conducts the Competition on its own behalf and for its own benefit, as well as provides its own prizes (hereinafter: "Organizer No. 1 ").

Competition Organizer No. 2 is INES Jewellery Magdalena Preuss Company, entered into the Central Register and Information on Economic Activity of the Republic of Poland maintained by the minister responsible for economy, with: business address: ul. 71
63-005 Poklatki correspondence address: INES Jewellery ul. 71 63-005 POKLATKI, NIP 7872136151, REGON 388413974, which conducts the Competition on its own behalf and for its own benefit, as well as provides its own prizes (hereinafter: "Organizer No. 2 ").
all together referred to as "Organizers"
1. The Organizers declare that the Competition is in no way sponsored, endorsed, administered, associated with, or conducted by the social media service Instagram. The social media service Instagram is not responsible for this Competition. All questions, comments, complaints, and claims related to the Competition should be directed to the Organizers, and in no case to the owner or administrator of the Instagram social media service.
2. The Organizers are co-organizers of the subject competition, who, as part of one joint promotional and advertising campaign, announce and conduct the subject competition. Each organizer is independently responsible for the proper, timely, and compliant with the regulations distribution of prizes to the winners, and each Organizer is fully responsible for all tax implications of the awarded prizes, including being responsible for collecting and paying taxes on prizes awarded by their respective businesses.
3. The Organizers are not related entities. Each organizer acts on its own behalf and for the benefit of its own business, and this competition is merely a joint action related to the promotion and advertising of products/goods offered by the Organizers, aiming to reach the largest possible group of people, customers, including disseminating information about the Organizers' products to encourage buyers to further cooperation, return, and repurchase of goods offered by the Organizers, which aims to increase sales for each of the organizers.
4. These Regulations define the rights and obligations of persons participating in the Competition. The Competition is an undertaking characterized by an element of rivalry to achieve the best possible result. The Competition is a procedure aimed at selecting a winner or several winners from a group of the best participants meeting specific criteria.
§ 2.
Location and Duration of the Competition
1. The competition will be jointly conducted by the Organizers indicated in paragraph 1 of these Regulations on the Instagram social media service of the Mother Earth brand https://www.instagram.com/motherearth_est.2047/ – i.e., Organizer No. 1.
2. The Competition will be held from April 14, 2026, to April 19, 2026.
3. The competition begins at the moment the competition task post (hereinafter: "Competition Task") is published on the Instagram account of Organizer No. 1, i.e., Mother Earth, located at: https://www.instagram.com/motherearth_est.2047/ (hereinafter "Instagram") on April 14, 2026.
4. The Competition Task must be completed by April 19, 2026, at 23:59:59.
5. The results will be announced no later than 5:00 PM on April 20, 2026.
6. In exceptional circumstances, the Organizers may extend or interrupt the duration of the Competition, to the extent specified by them, which will be announced on Instagram.
7. The content published on Organizer No. 1's Instagram regarding the competition is the content of all Organizers.
§ 3.
Competition Committee
To ensure the proper organization and conduct of the Competition, and in particular to assess the correctness of competition entries and to select and choose the Competition Winners, the Organizers shall establish their own independent competition committees (hereinafter: "Committee"). Each separate Committee of each Organizer shall consist of 3 members.
§ 4.
Participation in the Competition
1. The Competition is organized exclusively within the territory of the Republic of Poland.
2. Within the framework of the Competition, a person who meets the requirements stipulated in the Regulations and legal provisions has the opportunity to receive a prize provided for in the Regulations, funded separately by each Organizer indicated in paragraph 1 of these regulations (hereinafter: "Prize"), which means that each Organizer, at their own effort and expense, undertakes to award their own prizes/prize from their business after the winners meet all the requirements specified in the regulations and legal provisions, in particular tax law.
3. The Competition is in no case a game of chance, a raffle, a mutual bet, a promotional lottery, a game whose outcome depends on chance, or any other form provided for in the Act of November 19, 2009, on gambling (consolidated text Journal of Laws 2016.471 of April 8, 2016).
4. Only natural persons residing in the Republic of Poland, who are over 18 years of age and have full legal capacity (hereinafter: "Participant"), may participate in the Competition. Only a person who has accepted these Regulations may become a Participant in the Competition. The moment of accepting the Regulations is considered to be the moment of joining the Competition by performing the Competition Task. Participation in the Competition and the related provision of data are entirely voluntary.
5. A necessary condition for participation in the Competition is having one's own account on the Instagram social media service. To participate in the Competition, the Participant must meet the conditions indicated
in the Regulations and perform the Competition Task.
6. A Participant may participate in the Competition only personally. It is not permissible to create fictitious accounts and perform the Competition Task through them. It is also not permissible to perform the Competition Task on behalf of third parties.
7. Employees of the Organizers, members of the Organizers' authorities and representatives, and other entities directly involved in the preparation and conduct of the Competition, as well as persons cooperating with the aforementioned entities on a permanent basis other than an employment relationship, and members of their immediate families, i.e., ascendants, descendants, siblings, spouses, parents of spouses, and persons in an adoption relationship with them, may not participate in the Competition.
8. The Organizers reserve that participation in the Competition is at the Participant's own risk, and the Participant bears all consequences thereof, including legal ones, which also include liability for infringing the rights of third parties.
9. Proper completion of the Competition Task is equivalent to the Participant's acceptance of the provisions of the Regulations without the need to submit separate declarations on this matter.
10. A Participant who has joined the Competition by fulfilling the conditions of these Regulations is simultaneously bound by the terms of the Regulations.
§ 5.
Rules and Course of the Competition
1. On the first day of the Contest, i.e., April 19, 2026, a post containing the Contest Task will be published on Instagram.
2. The Contest Task involves the Participant providing an original statement (description) for the contest task placed in the post mentioned in item 1 above.
3. Participants may submit statements for the Contest Task
in the following manner:
4. publish statements as comments under the contest post on the social networking site Instagram, until 23:59:59 on the last day of the Contest, as indicated in § 2 item 4 of the Regulations;
5. Each Participant is entitled to publish 1 statement under the post as part of the Contest Task.
6. The Contest has one stage.
7. The Organizers reserve the right not to consider statements in the Contest that:
a) are inconsistent with the Instagram platform's regulations;
b) do not meet the criteria specified in the Regulations or are submitted inconsistently with the rules of the Regulations;
c) contain content contrary to good morals, immoral or offensive, or infringing applicable legal provisions;
d) infringe upon the rights, including in particular copyrights, or personal rights of third parties;
e) contain logos or advertising content related to any goods or services other than Mother Earth and INES Jewellery.
8. Proper execution of the Contest Task, in accordance with item 2 above, is equivalent to the Participant submitting the following declarations and commitments:
a) The statement submitted as part of the Contest Task constitutes an expression of the Participant's individual and original creativity;
b) The Participant holds all rights to the submitted statement, and these rights are not in any way restricted or encumbered in favor of third parties;
c) The use by the Organizer of the statement submitted as part of the Contest Task, in accordance with the Contest Regulations, will not endanger or infringe anyone's rights, assets, or legally protected secrets.
d) Upon publishing a statement under the contest post, the Participant exclusively, free of charge, for an unlimited period and without territorial restrictions, transfers to the Organizers the proprietary copyrights to the slogans, statements, or other original works of the Participant submitted as part of the Contest Task, hereinafter collectively referred to as "Works," in the following fields of exploitation:
e) Permanent or temporary recording and reproduction of the Works or their parts by any technique, at any scale, and on any material, including in particular by electronic, magnetic, and optical recording on all carriers, including computer disks and using private and public networks, including the public Internet network;
f) Placing the Works or their parts on the internet and on all media used for advertising and promotion;
g) Broadcasting the Works or their parts by wired or wireless vision or sound, by terrestrial station, via satellite, simultaneous and integral broadcasting of the Works or their parts broadcast by another radio or television organization;
h) Making the Works or their parts available to ensure access to them at a chosen place and time (Internet or other computer networks);
i) Introducing the Works or their parts into circulation, including their sale;
j) Using the Works or their parts in open networks, internal networks, satellite, and radio broadcasts;
k) Using the Works or their parts in any form chosen by the Organizers for marketing purposes;
l) Introducing the Works or their parts into the memory of computers and other similarly operating devices;
m) Adapting the Works or their parts for various types of recipients by giving them various forms and recording, duplicating, distributing, and putting into circulation such modified Works or their parts;
n) Reproducing and introducing any changes, in whole or in part, to the Works by modifying their color, layout, font, and the right to make translations and summaries;
o) Adapting, extending, changing the layout, or any other changes and modifications to the Works or their parts, including converting their original format to any other format and adapting them to the Organizers' hardware and system platforms;
p) Processing (adapting) the Works or their parts and combining their fragments with other Works;
q) Distributing copies of modified Works or their parts, as well as their individual copies;
r) Digitization of the Works or their parts;
s) Any use of the Works or their parts;
t) Recording, duplicating, and using the Works or their parts by placing them in printed magazines;
u) Displaying, applying, transmitting, storing, and repairing the Works or their parts;
v) Granting licenses and other similar rights for the use of the Works or their parts by third parties;
w) Allowing the exercise of derivative copyrights, including rental and lease rights.
9. By publishing a statement under the contest post, the Participant declares that they bear full responsibility for the infringement of any rights, including the copyrights of third parties, for the statement submitted to the Contest as part of the Contest Task.
§ 6.
Rules for selecting winners. Prizes
1. The published statements will be evaluated by the Commission.
2. After the Contest ends, 1 winner will be selected for the contest (hereinafter: "Winner").
3. The Winner will receive a prize in the form of:
a) From Organizer No. 1, i.e., Mother Earth: SHOPPING VOUCHER WORTH PLN 300 and a LIMITED MIAMI BAG
b) From Organizer No. 2, i.e., the company: SHOPPING VOUCHER WORTH PLN 200
(hereinafter: "Prize" or "Prizes").
4. In this contest, the winner will be selected by the Commission of Organizer No. 1, i.e., the Mother Earth company, in consultation with Organizer No. 2, i.e., INES Jewellery.
5. The Winner is entitled to one Prize from each Organiser indicated above, under the terms specified in the Regulations and legal provisions.
6. Each Organiser's committee shall assess the creativity of the submitted statements and the compliance (correctness) of the published statements with the Competition Task and the Regulations. The Organisers reserve the right not to justify the selection of a given statement.
7. The Committee's decision is final.
8. The Winners will be informed of the awarding of the Prize no later than 2 (two) business days after the end of the Competition, by means of a comment from the Organisers under the competition post.
9. In addition to the Prize, Winners will also receive an additional cash prize in the amount specified by law, which will not be issued to the Winners and will be used to cover the lump-sum income tax due on the Prize in accordance with applicable regulations (if applicable).
10. The condition for receiving the Prize is that the Winner provides the Organiser with the following information to the email address [online@motherearth.store] and [https://www.instagram.com/ines_jewellery/]
a) Winner's first name and surname;
b) correspondence address (street, house number, apartment number, postal code, city);
c) phone number;
d) email address;
e) all data necessary for the Organiser to fulfil tax obligations and duties arising from legal provisions, in particular tax law, and especially the PESEL number, the Winner's residence address, and the name and address of the tax office competent for the Winner (if applicable).
11. The above data should be provided to each of the Organisers separately at the email addresses indicated above within 7 days of the Winner being notified of the win. If the Winner fails to fulfil this obligation within the aforementioned deadline, the Prize will remain at the Organisers' disposal, who may award it to another Participant or retain it in their resources.
12. After fulfilling the conditions of the Regulations, the Prizes will be sent by the Organisers to the Winners at the correspondence address provided by them, or the delivery address via a postal operator or a courier company chosen by each Organiser, within 14 business days from sending/providing the data referred to in point 10 above. Each Organiser is personally responsible for issuing prizes within the deadlines specified in the regulations.
13. The Organisers reserve that they are not liable for the inability to transfer the Prize due to reasons attributable to the Winner, and in particular in the case of:
a) Providing the data referred to in point 10 above after the expiry of the 7-day period from the Winner's notification of the win;
b) Providing incorrect, untrue, incomplete or inaccurate data as referred to in point 9 above;
c) Making incorrect or untrue declarations as referred to in § 5, point 7;
d) Failure to collect the shipment sent to the Winner.
e) In such a case, the Prize remains at the disposal of the Organisers, who may award it to another Participant or retain it in their resources.
f) The Winner forfeits the right to the Prize if they violate or fail to comply with any of the provisions of the Regulations.
g) In the event of the Winner's resignation from the Prize, the Organisers reserve the right to award the Prize to the next Participant indicated by the Competition Committee. Resignation from part of the Prize is equivalent to resignation from the entire prize.
14. It is not possible to pay the Winner the cash equivalent of the Prize or to exchange the Prize for another material prize.
15. It is not possible for the Winner to transfer the right to the Prize to third parties.
16. Each Organiser shall cover the shipping costs of the order if the InPost Parcel Lockers option is selected. If another delivery option is chosen, the shipping cost shall be covered by the Winner.
§ 7. Personal data
1. By submitting participation in the Competition, the Participant, being a natural person, agrees to the processing of their personal data by the Organiser and Co-organiser in accordance with the law.
2. Providing data is voluntary but necessary for participation in the Competition. Completing the competition entry form is equivalent to accepting their processing for the purposes of the Competition.
3. The Participant provides the following personal data: when applying for the Competition: first name, last name, email address, date of birth; for receiving the Prize: data required for issuing the appropriate PIT form and paying income tax on the Prize; when submitting a complaint: first name, last name, email address, residential address, date of birth;
4. The Organiser, as the personal data administrator, informs that:
a) It is the administrator of the Participant's personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR); b. The Participant's personal data will be processed:
(I) for purposes related to the organisation and conduct of the Competition, and in the case of separate consents, also for marketing purposes (direct marketing), based on Article 6(1)(a) of the GDPR;
(II) for the purpose of exercising copyright as indicated in § 8 above, based on Article 6(1)(b) and (f) of the GDPR;
(III) for the purpose of handling claims based on Article 6(1)(f) of the GDPR.
5. The personal data of the Competition Participants will be processed by the Organiser for the period necessary to achieve the purposes for which they were collected, i.e., the Participants' data until the end and resolution of the Competition and for the period of expiration of any claims of the Participants related to the Competition, the Winner's data until the expiration of any claims of the Winner and for reporting purposes required by law; the handling of complaints for the period of expiration of any claims of the person filing the complaint; the exercise of copyright as indicated in § 8 for the duration of such rights.
6. The Co-organiser, as the personal data administrator, informs that:
a) It is the administrator of the Participant's personal data within the meaning of the GDPR;
b) The Participant's personal data will be processed:
(I) for purposes related to the organisation and conduct of the Competition, and in the case of separate consents, also for marketing purposes (direct marketing), based on Article 6(1)(a) of the GDPR;
(II) for the purpose of exercising copyright as indicated in § 8 above, based on Article 6(1)(b) and (f) of the GDPR;
(III) for the purpose of handling claims based on Article 6(1)(f) of the GDPR.
7. The personal data of the Contest Participants will be processed by the Organizer for the period necessary to achieve the purposes for which it was obtained, i.e., the data of the Participants until the completion and resolution of the Contest and for the period of expiry of any claims of the Participants related to the Contest, the data of the Winner until the expiry of any claims of the Winner and for the purposes of reporting required by law; processing of complaints for the period of expiry of any claims.
8. Contest Participants have the right to request access to their personal data, rectification, erasure or restriction of processing of such data, and the right to object to processing, as well as the right to data portability, to the extent provided by law.
9. Contest Participants have the right to withdraw their consent to the processing of their personal data at any time, which, however, does not affect the lawfulness of processing carried out on the basis of consent given before its withdrawal – for this purpose, Contest Participants should send relevant information to the Organizer's address 1 [ul. Ziołowa 29, 43-465 Wilkowice] or to the Co-Organizer's address [ul. Jacek i Agatka 4/13, 02-495 Warsaw].
10. Contest Participants have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.
11. Decisions regarding the course of the Contest will not be made in an automated manner and will not be subject to profiling.
12. Recipients of personal data may include: employees or associates of the Organizer or Co-Organizer of the Contest, as well as entities providing postal, courier, banking, advisory, financial, accounting, tax, auditing, legal services or services related to hosting or IT systems and software to the Organizer or Co-Organizer of the Contest.
§ 8. Complaint procedure
1. Complaints regarding matters related to the Contest should be submitted via email to: [online@motherearth.store].
2. Complaints regarding the prize awarded by Organizer 1 should be submitted via email to: [online@motherearth.store].
3. Complaints regarding the prize awarded by Organizer 2 should be submitted via Instagram to: [https://www.instagram.com/ines_jewellery/].
4. Complaints may be submitted throughout the duration of the Contest and no later than 30 days from the end of the Contest.
5. Complaints will be processed within 14 business days from the date of delivery of the complaint in the manner specified in item 1 above. The Participant will be informed about the outcome of the complaint via email, to the address from which the complaint was sent.
§ 9. Final provisions
1. The Contest Regulations are available on the blog and at the Organizers' offices throughout the duration of the Contest.
2. The Regulations come into force at the moment of their publication on the blog.
3. Participation in the Contest involves receiving email information that may constitute commercial information within the meaning of Article 2, paragraph 1, point 2 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws 2002 No. 144, item 1204). The Participant agrees to receive commercial information from:

5. Any information about the Contest contained in promotional and advertising materials is for informational purposes only, while the scope of rights of Participants and Organizers is regulated and assessed on the basis of the provisions of these Regulations.
