"Vacation with Mother Earth"

1. Contest Organizer

  1. The contest is organized by "Alex" Aleks Nowicki, a company registered in the Central Register and Information on Economic Activity of the Republic of Poland, maintained by the minister responsible for economic affairs, with:

  1. The Organizer acts on its own behalf and for its own benefit and is responsible for the implementation of the contest, including the awarding of prizes.

 

2. Contest Duration

The contest runs from July 3, 2026, to July 10, 2026. 

3. Contest Participants

  1. Any natural person with an active Instagram account may participate in the contest.
  2. Participation in the contest is voluntary and free of charge. 

4. Rules for Participation in the Contest

To participate in the contest, you must:

  1. Publish a photo or story on Instagram that features the Mother Earth brand or its products, or related inspirations.
  2. Tag the Organizer's profile: @motherearth_est.2047 

5. Rules for Selecting Winners

  1. Each day of the contest, the Organizer will select 3 (three) winners from among the valid submissions.
  2. Selection criteria will primarily include creativity, aesthetics, and the submission's relevance to the contest theme.
  3. The Organizer reserves the right not to justify individual decisions regarding the selection of winners. 

6. Prizes

  1. Each winner will receive a surprise gift set ("GIFT BOX") from the Mother Earth brand.
  2. Prizes will be sent to the address provided by the winner in a private message (DM) on Instagram.
  3. Prizes are not exchangeable for cash or other goods. 

7. Announcement of Results

  1. Winners will be notified of their win via private message (DM) on Instagram.
  2. Failure to respond within the deadline specified by the Organizer may result in the forfeiture of the right to the prize. 

8. Copyright and Consent to Use Image Content

  1. The participant declares that they possess full rights to the published content (in particular photos and video materials) and that they do not infringe the rights of third parties.
  2. By submitting the contest entry, the participant grants the Organizer a non-exclusive, gratuitous consent to use the submitted content for marketing purposes of the Mother Earth brand, in particular by reposting, publishing, and using them in online promotional materials.
  3. The participant acknowledges that contest materials tagged with the Organizer's profile or related to the Mother Earth brand may be published on the Organizer's official Instagram profile.

9. Personal Data

  1. The administrator of participants' personal data is the Organizer.
  2. Personal data is processed solely for the purpose of conducting the contest, including selecting winners and sending prizes.
  3. Data is not shared with third parties, except for entities necessary for sending prizes.
  4. Providing data is voluntary, but necessary to receive the prize. 

10. Final Provisions

  1. The contest is not sponsored, supported, administered by, or associated with Instagram.
  2. Instagram is not responsible for the organization of the contest.
  3. The Organizer reserves the right to amend these rules for important organizational reasons, provided that such changes do not infringe upon the acquired rights of participants.

 

 

Contest Rules of the Organizers

“Mother Earth  & INES Jewellery”

(hereinafter: “Rules”) 

§ 1. Organizer 

The organizers of this contest (hereinafter: “Contest”)  are: 

1.      Contest Organizer no. 1 is the company "Alex" Aleks Nowicki, registered in the Central Register and Information on Economic Activity of the Republic of Poland, maintained by the minister responsible for economic affairs, having: address of business activity: ul. Jacka i Agatki 4/13, 02-495 Warsaw and correspondence address: "Mother Earth" ul. Jacka i Agatki 4/13, 02-495 Warsaw, NIP 5222840217, REGON 142713260, which conducts the Contest on its own behalf and for its own benefit, and also provides its own prizes (hereinafter: “Organizer no. 1 ”).

Contest Organizer no. 2 is the company INES Jewellery Magdalena Preuss, registered in the Central Register and Information on Economic Activity of the Republic of Poland, maintained by the minister responsible for economic affairs, having: address of business activity: ul. 71

 correspondence address: INES Jewellery ul. 71 63-005 POKLATKI,  NIP 7872136151, REGON 388413974, which conducts the Contest on its own behalf and for its own benefit, and also provides its own prizes (hereinafter: “Organizer no. 2 ”).

all collectively referred to as the “Organizers”

1.             The Organizers declare that the Contest is not sponsored, endorsed, administered by, associated with, or conducted by the social media service Instagram in any way. The Instagram social media service is not responsible for this Contest. All questions, comments, and complaints related to the Contest should be directed to the Organizers, and in no case to the owner or administrator of the Instagram social media service.

2.             The Organizers are co-equal organizers of the subject contest, who, within the framework of one joint promotional and advertising campaign, announce and conduct the subject contest. Each organizer is individually responsible for the proper, timely, and rule-compliant awarding of prizes to the winners, and each Organizer is individually fully responsible for all tax consequences of the prizes awarded, including being responsible for collecting and remitting tax on prizes issued by their own enterprise.

3.             The Organizers are not related entities. Each organizer acts on its own behalf and for its own enterprise, and this contest is merely a joint action related to the promotion and advertising of products/goods offered by the Organizers, aimed at reaching the widest possible group of people, customers, including disseminating information about the Organizers' products to encourage buyers to continue cooperation, return, and repurchase goods from the Organizers' offer, which aims to increase sales for each of the organizers.

4.             These Rules define the rights and obligations of persons participating in the Contest. The Contest is an undertaking characterized by the element of competition to achieve the best possible result. The Contest is a procedure aimed at selecting a winner or several winners from among the group of best participants who meet specific criteria.

§ 2.

Place and Duration of the Contest 

1.             The Contest will be jointly conducted by the Organizers  mentioned in paragraph 1 of these Rules  on the Instagram social media service of the Mother Earth brand https://www.instagram.com/motherearth_est.2047/  – i.e., Organizer no. 1.

2.             The competition will be held from April 14, 2026, to April 19, 2026.

3.             The competition begins when Organizer No. 1, Mother Earth, located at https://www.instagram.com/motherearth_est.2047/ (hereinafter "Instagram"), publishes a post containing the competition task (hereinafter: "Competition Task") on April 14, 2026.

4.             The Competition Task must be completed by April 19, 2026, at 23:59:59.

5.             The results will be announced no later than 5:00 PM on April 20, 2026.

6.             In exceptional circumstances, the Organizers may extend or interrupt the competition for a period determined by them, about which they will inform on Instagram.

7.             Content placed on Organizer No. 1's Instagram regarding the competition represents the content of all Organizers. 

§ 3.

Competition Committee 

To ensure the proper organization and conduct of the Competition, and in particular to assess the correctness of competition entries and to select the Competition Winners, the Organizers shall appoint their own independent competition committees (hereinafter: "Committee"). Each separate Committee of each Organizer shall consist of 3 persons.  

§ 4.

Participation in the Competition 

1.             The competition is organized exclusively within the territory of the Republic of Poland.

2.             Within the framework of the Competition, a person who meets the requirements stipulated in the Regulations and legal provisions  has the possibility to receive a prize provided for in the Regulations, funded separately by each Organizer indicated in paragraph 1 of these regulations (hereinafter: "Prize"), meaning that each Organizer, at their own effort and expense, undertakes to provide prizes from their own enterprise after the winners meet all the requirements specified in the regulations and legal provisions, especially tax law.

3.             The Competition is in no way a lottery, prize draw, mutual bet, promotional lottery, game of chance, or any other form provided for in the Act of November 19, 2009, on gambling games (consolidated text Journal of Laws 2016.471 of April 8, 2016).

4.             Only natural persons residing in the territory of the Republic of Poland, who are over 18 years of age and have full legal capacity (hereinafter: "Participant"), may participate in the Competition. Only a person who has accepted these Regulations can become a Participant in the Competition. The moment of acceptance of the Regulations is considered to be the moment of joining the Competition by performing the Competition Task. Participation in the Competition and the related provision of data is entirely voluntary.

5.             A necessary condition for participation in the Competition is having one's own Instagram social media account. To participate in the Competition, the Participant must meet the conditions indicated
in the Regulations and perform the Competition Task.

6.             Participants may only take part in the Competition personally. The creation of fictitious accounts and the performance of Competition Tasks through them is not allowed. It is also not allowed to perform Competition Tasks on behalf of third parties.

7.             Employees of the Organizers, members of the management and representatives of the Organizers and other entities directly involved in the preparation and conduct of the Competition, as well as persons cooperating with the aforementioned entities on a permanent basis other than an employment relationship and members of their immediate families, i.e., ascendants, descendants, siblings, spouses, parents of spouses and persons related to them by adoption, may not participate in the Competition.

8.             The Organizers reserve that participation in the Competition is at the Participant's own risk, and they bear all consequences, including legal ones, covering also liability for infringement of third party rights.

9.             The correct performance of the Competition Task is equivalent to the Participant's acceptance of the provisions of the Regulations without the need to submit separate declarations on this matter.

10.         A Participant who has entered the Competition meeting the conditions of these Regulations is simultaneously bound by the terms of the Regulations.

§ 5.

Rules and course of the Competition 

1.             On the first day of the Competition, April 19, 2026, a post containing the Competition Task will be published on Instagram.

2.             The Competition Task consists of the Participant providing an original statement (description) in response to the competition question placed in the post mentioned in item 1 above.

3.             Participants may submit statements for the Competition Task
in the following manner:

4.             publish statements under the competition post on the Instagram social media platform, in the form of a comment, by 23:59:59 on the last day of the Competition, as indicated in § 2, item 4 of the Regulations;

5.             Each Participant is entitled to publish 1 statement under the post as part of the Competition Task.

6.             The competition is a single-stage competition.

7.             The Organizers reserve the right not to consider statements in the Competition that:

a)            are inconsistent with the Instagram portal regulations;

b)            do not meet the criteria specified in the Regulations or are submitted inconsistently with the rules of the Regulations;

c)             contain content contrary to good morals, immoral or offensive, or infringing applicable legal provisions;

d)            infringe rights, in particular copyrights, or personal rights of third parties;

e)            contain logos or advertising content related to any goods or services other than Mother Earth  and INES Jewellery

8.             The correct performance of the Competition Task, in accordance with item 2 above, is equivalent to the Participant submitting the following declarations and commitments:

a)            The statement provided as part of the Competition Task constitutes an expression of the Participant's individual and original creativity;

b)            The Participant holds all rights to the submitted statement and these are not in any way restricted or encumbered in favor of third parties;

c)             The Organizer's use of the statement provided as part of the Competition Task, in accordance with the Competition Regulations, will not jeopardize or infringe anyone's rights, assets, or legally protected secrets.

d)            Upon publication of the statement under the competition post, the Participant transfers to the Organizers, exclusively, free of charge, for an unlimited period and without territorial restrictions, the proprietary copyrights to the slogans, statements, or other original works of the Participant included in the statement submitted as part of the Competition Task, hereinafter collectively referred to as "Works," for the following fields of exploitation:

e)            Permanent or temporary recording and multiplication of the Works or their parts by any technique, on any scale and material, including in particular by electronic, magnetic, and optical recording on all media, including computer disks and using private and public networks, including the public Internet network;

f)              Placing Works or parts thereof on the Internet and on all media used for advertising and promotion;

g)            Broadcasting Works or parts thereof by wire or wireless vision or sound, by a terrestrial station, via satellite, simultaneous and integral broadcasting of Works or parts thereof broadcast by another radio or television organisation;

h)            Making Works or parts thereof available for access at a chosen place and time (Internet or other computer networks);

i)              Introduction of Works or parts thereof into circulation, including their disposal;

j)              Use of Works or parts thereof in open networks, internal networks, satellite and radio transmissions;

k)            Using Works or parts thereof in any form chosen by the Organisers for marketing purposes;

l)              Entering Works or parts thereof into the memory of computers and other similar devices;

m)          Adapting Works or parts thereof for different types of recipients by giving them different forms and recording, reproducing, distributing and marketing such modified Works or parts thereof;

n)            Reproducing and making any changes to all or part of the Works by modifying their colour, layout, font, as well as the right to make translations and summaries;

o)            Adapting, expanding, changing the layout or any other changes and modifications to the Works or parts thereof, including converting their original format to any other format and adapting them to the Organisers' hardware and system platforms;

p)            Processing (adapting) Works or parts thereof and combining their fragments with other Works;

q)            Distributing copies of modified Works or parts thereof, as well as their individual copies;

r)             Digitisation of Works or parts thereof;

s)             Any use of Works or parts thereof;

t)              Recording, multiplying and using Works or parts thereof by placing them in printed magazines;

u)            Displaying, using, transmitting, storing and repairing Works or parts thereof;

v)            Granting licences and other similar rights for the use of Works or parts thereof by third parties;

w)          Authorising the exercise of dependent copyright, including the right of lease and rental.

9.             By posting a statement under the contest post, the Participant declares that they bear full responsibility for the infringement of any rights, including copyrights of third parties, for the statement submitted to the Contest as part of the Contest Task.

§ 6.

Rules for selecting winners. Prizes 

1.             Published statements will be assessed by the Commission.

2.             After the Contest, 1 winner per contest will be selected (hereinafter: "Winner").

3.             The Winner will receive a prize in the form of:

a)            From Organiser No. 1, i.e., Mother Earth: SHOPPING VOUCHER WORTH PLN 300 and a LIMITED MIAMI BAG

b)            From Organiser No. 2, i.e., the company: SHOPPING VOUCHER WORTH PLN 200

(hereinafter: "Prize" or "Prizes").

4.             In this contest, the winner will be selected by the Commission of Organiser No. 1, i.e., Mother Earth, in agreement with Organiser No. 2, i.e., INES Jewellery

5.             The Winner is entitled to one Prize from each Organiser indicated above, under the terms specified in the Regulations and legal provisions.

6.             Each of the Organisers' commissions will base its assessment on the creativity of the statements provided and the compliance (correctness) of the published statements with the Contest Task and the Regulations. The Organisers reserve the right not to justify the choice of a particular statement.

7.             The Commission's decision is final.

8.             Winners will be informed about the award of the Prize within no more than 2 (two) business days after the end of the Contest, via the Organisers' comment under the contest post.

9.             In addition to the Prize, Winners will also receive an additional cash prize in the amount specified by law, which will not be disbursed to the Winners and will be allocated to cover the due lump-sum income tax on the Prize in accordance with applicable regulations (if applicable).

10.         The condition for receiving the Prize is for the Winner to provide the Organiser with the following information to the email addresses [online@motherearth.store] and [https://www.instagram.com/ines_jewellery/]

a)            Winner's first and last name;

b)            Correspondence address (street, house number, apartment number, postal code, town);

c)             Telephone number;

d)            Email address;

e)            All data necessary for the Organiser to fulfil its obligations and tax duties arising from legal provisions, particularly tax law, and in particular the Winner's PESEL number, residential address, and the name and address of the tax office relevant to the Winner (if applicable).

11.         The above data should be submitted to each of the Organisers separately at the email addresses indicated above within 7 days of the Winner being notified of the win. If the Winner fails to comply with this obligation within the aforementioned deadline, the Prize will remain at the disposal of the Organisers, who may award it to another Participant or keep it in their resources.

12.         Upon fulfillment of the terms of the Regulations, the Prizes will be sent by the Organisers to the Winners at the correspondence address indicated by them, delivery address via postal operator or a courier company chosen by each Organiser within 14 working days from the submission / transfer of the data referred to in paragraph 10 above. Each organiser is personally responsible for issuing prizes within the deadlines specified in the regulations.

13.         The Organisers reserve that they are not responsible for the inability to transfer the Prize due to reasons attributable to the Winner, and in particular in the event of:

a)            Providing the data referred to in paragraph 10 above after the expiry of 7 days from the notification of the Winner about the win;

b)            Submission of incorrect, untrue, or incomplete data, as referred to in section 9 above;

c)             Submission of false or untrue statements, as referred to in § 5 section 7;

d)            Failure to collect a shipment sent to the Winner.

e)            In such a case, the Prize remains at the disposal of the Organizers, who may award it to another Participant or keep it within their resources.

f)              The Winner forfeits the right to the Prize if they violate or fail to comply with any of the provisions of the Regulations.

g)            In the event of a Winner resigning from the Prize, the Organizers reserve the right to award the Prize to the next Participant indicated by the Competition Committee. Resignation from part of the Prize is equivalent to resignation from the entire prize.

14.         It is not possible to pay the Winner a monetary equivalent of the Prize or to exchange the Prize for another material prize.

15.         It is not possible for the Winner to transfer the right to the Prize to third parties.

16.         Each Organizer shall cover the shipping costs of the order if the InPost Parcel Lockers option is selected. If another delivery option is selected, the shipping cost shall be borne by the Winner.

§ 7. Personal data 

1.             By applying to participate in the Competition, the Participant, being a natural person, consents to the processing of their personal data by the Organizer and Co-Organizer in accordance with the law.

2.             Providing data is voluntary, but necessary for participation in the Competition. Completing the competition application is equivalent to accepting their processing for the purposes of the Competition.

3.             The Participant provides the following personal data: when applying for the Competition: first name, last name, email address, date of birth; for the purpose of collecting the Prize: data required for issuing the appropriate PIT form and paying income tax on the Prize; when submitting a complaint: first name, last name, email address, residential address, date of birth;

4.             The Organizer, as the personal data administrator, informs that:

a)            It is the administrator of the Participant's personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR); b. The Participant's personal data will be processed:

(I)           for purposes related to the organization and conduct of the Competition, and in the case of separate consents, also for marketing purposes (direct marketing), on the basis of Article 6(1)(a) of the GDPR;

(II)        for the purpose of exercising copyrights as indicated in § 8 above, on the basis of Article 6(1)(b) and (f) of the GDPR;

(III)     for the purpose of handling claims on the basis of Article 6(1)(f) of the GDPR.

5.             The personal data of Competition Participants will be processed by the Organizer for the period necessary to achieve the purposes for which they were collected, i.e., Participant data until the end and resolution of the Competition and for the period of expiry of any claims of Participants related to the Competition, Winner data until the expiry of any claims of the Winner and for reporting purposes required by law; complaint processing for the period of expiry of any claims of the person submitting the complaint; exercising copyright entitlements indicated in § 8 for the period of possessing such entitlements.

6.             The Co-organizer, as the personal data administrator, informs that:

a)            It is the administrator of the Participant's personal data within the meaning of the GDPR;

b)            The Participant's personal data will be processed:

(I)           for purposes related to the organization and conduct of the Competition, and in the case of separate consents, also for marketing purposes (direct marketing), on the basis of Article 6(1)(a) of the GDPR;

(II)        for the purpose of exercising copyrights as indicated in § 8 above, on the basis of Article 6(1)(b) and (f) of the GDPR;

(III)     for the purpose of handling claims on the basis of Article 6(1)(f) of the GDPR.

7.             The personal data of Competition Participants will be processed by the Organizer for the period necessary to achieve the purposes for which they were obtained, i.e. Participant data until the end and resolution of the Competition and for the period of expiry of any claims of Participants related to the Competition, Winner data until the expiry of any claims of the Winner and for reporting purposes required by law; complaint processing for the period of expiry of any claims.

8.             Competition Participants have the right to request access to their personal data, rectification, erasure or restriction of processing of such data, and the right to object to processing, as well as the right to data portability, to the extent provided by law.

9.             Competition Participants have the right to withdraw their consent to the processing of their personal data at any time, which, however, does not affect the lawfulness of processing carried out on the basis of the consent given before its withdrawal - for this purpose, Competition Participants should send appropriate information to the Organizer's address 1 [Ziołowa 29, 43-465 Wilkowice] or to the Co-organizer's address [ul. Jacka i Agatki 4/13, 02-495 Warsaw].

10.         Competition Participants have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.

11.         Decisions regarding the course of the Competition will not be made in an automated manner and will not be subject to profiling.

12.         Recipients of personal data may include: employees or associates of the Organizer or Co-organizer of the Competition, as well as entities providing postal, courier, banking, advisory, financial, accounting, tax, auditing, legal services or services related to IT systems and software to the Organizer or Co-organizer of the Competition.

§ 8. Complaint procedure 

1.             Complaints regarding matters related to the Competition should be submitted via email to: [online@motherearth.store].

2.             Complaints regarding the awarding of the prize by Organizer 1 should be submitted via email to: [online@motherearth.store].

3.             Complaints regarding the awarding of the prize by Organizer 2 should be submitted via Instagram to: [https://www.instagram.com/ines_jewellery/].

4.             Complaints can be submitted throughout the duration of the Competition and no later than 30 days from the end of the Competition.

5.             Complaints will be considered within 14 working days from the date of delivery of the complaint in the manner specified in section 1 above. The Participant will be informed about the outcome of the complaint via electronic mail, to the email address from which the complaint was sent.

§ 9. Final provisions 

1.             The Competition Regulations are available on the blog and at the Organizers' offices throughout the duration of the Competition.

2.             The Regulations come into effect upon their publication on the blog.

3.             Participation in the Competition involves receiving email information that may constitute commercial information within the meaning of Art. 2 sec. 1 point 2 of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws 2002 No. 144, item 1204). The Participant agrees to receive commercial information from:

5.             All information about the Competition contained in any promotional and advertising materials is for auxiliary purposes only, while the scope of participants' and organizers' rights is regulated and assessed based on the provisions of these Regulations.
